1.1 The English Placement Test, which is hosted in the URL www.mmplacement.com, together with any content, tools, features, and functionality offered on or through the Website ("Website"), helps users identify their level of English and suggest courses that are right for them. The Website is operated by company under the name “E. MOUTSOY & CO G.P.” and the distinctive title “M M Publications”, based at 20, Lakonias street, Attiki PO 17456 Greece, Tax Registration Number: 084257473, Tax Office: Glyfada, General Commercial Registry (G.E.MI.) No.: 002875401000, (hereinafter referred to as “MM Publications”, “the Company”, “we”, “us”).

1.2 Access and use of the Website is subject to the following Terms and Conditions of Service (“Terms and Conditions”). By accessing or using any part of the Website, you represent and warrant to MM Publications that: (i) you are at least 15 years old (or equivalent minimum age depending on jurisdiction), or you have the permission of your parent or guardian to use the Website, and that your parent or guardian has read and agreed to these Terms and Conditions on your behalf and (ii) all information you submit is accurate and truthful. These Terms and Conditions are void where prohibited by law, and the right to access the Website is revoked in such jurisdictions.

1.3 By accessing or using any part of the Website, you represent that you have read, understood, and agree to be bound by these Terms and Conditions including any future modifications. You should visit this page regularly to check for any changes made to the Terms and Conditions. MM Publications reserves the right to amend, update or upgrade at any time, without prior notice: a) part or the whole of the Terms and Conditions, b) part or the whole of this Website’s content and c) part or the whole of the exterior appearance (interface), the structure or composition (configuration) of this Website and its technical specifications, as well as limiting access to the entire Website or part of it. MM Publications may also, in its sole discretion, update, change, suspend, make improvements to or discontinue any aspect of the Website, temporarily or permanently, at any time, without prior notice.

2. Your License to use this Website

2.1 Subject to your compliance with these Terms and Conditions, MM Publications hereby grants to you, a personal, limited, royalty-free, non-assignable, non-sublicensable, non-transferrable, and non-exclusive license to use the software provided to you as part of the Website. This license has the sole purpose of enabling you to use and enjoy the benefit of the Website as provided by us in the manner permitted by these Terms and Conditions and subject to the use restrictions described below.

2.2 In exchange for the limited license to access and use this Website, you may not do any of the following, unless applicable laws or regulations prohibit these restrictions, or you have our written permission to do so:

use the English Placement Test to collect information about our testing process or to develop strategy, guides or other testing preparation material or a similar testing service, and you may not violate any rules applicable to the English Test or otherwise cheat or circumvent the applicable procedures when taking an English Test;
download, modify, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works from, or offer for sale any information contained on, or obtained from or through, the Website;
access or use the Website in any manner that could disable, overburden, damage, disrupt or impair the Website or interfere with any other party's access to or use of the Website or use any device, software or routine that causes the same (including viruses and other malware);
attempt to gain unauthorized access to the Website, or the computer systems or networks connected to the Website; • circumvent, remove, alter, deactivate, degrade or thwart any technological measure or content protections of the Website;
use any automatic device, process, software that intercepts, “mines,” scrapes or otherwise accesses the Website to monitor, extract, copy or collect information or data from or through the Website, or engage in any manual process to do the same;
use the Website for illegal, harassing, unethical, or disruptive purposes;
violate any applicable law or regulation in connection with your access to or use of the Website; or
access or use the Website in any way not expressly permitted by these Terms and Conditions.

2.3 Access and use of the Website does not grant or provide you with the right or license to reproduce or otherwise use the MM Publications name or any MM Publications or third-party trademarks, service marks, graphics, or logos.

3. English Placement Test Policy

3.1 In order to take the English Placement Test, either in British English or American English, you are required to complete the following email verification process:

Enter your email address and click the red button that appears in the respective field.
Go to your email account.
Open the email with the subject line "Email Verification Code".
Copy your verification code displayed in the email.
Enter the verification code in the respective field.
Tap continue.

If you received an email verification code in error, it's likely that another user accidentally entered your email. If you didn't initiate the request, you don't need to take any further action. You can simply disregard the verification email.

3.2 Each test consists of three parts. Each part must be completed within 40 minutes. If you fail to do so, then your test session will expire, and all progress will be lost.

3.3 If you press the browser's back or refresh buttons during your examination, you will lose all your progress.

3.4 When you have finished with the test, you will receive an email with your results. If you have submitted your teacher’s email address, your test results will be shared with your teacher.

3.5 Once you completed the English Placement Test, you must wait at least 48 hours, in order to take the test again.

4. Third-Party Links, Sites, and Services

The Website may contain links to third-party websites, services, or other events or activities that are not owned or controlled by us. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third-party website, service, or content from MM Publications, you understand that these Terms and Conditions and our Privacy Policy do not apply to your use of such sites. You expressly acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss arising from your use of any third-party website, service, or content.

5. Intellectual Property

5.1 The Website and all content available through the Website, including designs, text, graphics, images, information, software, audio and other files, and their selection and arrangement (the “Website Content”), are the proprietary property of MM Publications or its licensors and are protected by international copyright laws and treaties on intellectual property rights.

5.2 You are authorized to access and use this Website for your own personal use. No Website Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, other than as expressly permitted in these Terms and Conditions.

6.4 MM Publications and our partners make every possible effort, in the context of the technical control they carry out at regular intervals, to ensure that there is seamless and uninterrupted access to the content and services of this Website while maintaining the Company’s high safety level. However, our Company cannot be held liable if for any reason, including negligence, the operation of MM Publications is interrupted or hindered and/or it is not possible to access it and/or if, despite the applied security measures, "viruses" or other malicious software are identified and transmitted to the terminals of users or if unauthorized third parties intervene in any way in the content and operation of the Website hindering its use, causing problems to its proper functioning or stealing data related to users' personal information. Furthermore, we cannot be held liable in case of interruption to the access to our Website for reasons beyond our sphere of influence, as well as due to technical or other network failure, force majeure, or unexpected events.

7. Indemnification of MM Publications

You agree to indemnify, defend, and hold harmless MM Publications, its directors, officers, employees, consultants, agents, licensors, successors, and affiliates, from any and all third-party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of the Website, any false representation made to us (as part of these Terms and Conditions or otherwise), your negligence or willful misconduct, or your breach of these Terms and Conditions.

8. Data collection

MM Publications does not collect personally identifiable data from users using the Website unless they have explicitly provided such data to us, when they register to take the English Placement Test. The manner in which we treat users’ personal data is described in more detail in our Privacy Policy, which forms part of the agreement. You acknowledge that the processing of your personal data as described in the Privacy Policy does not constitute a violation of your privacy. 9. Termination

If you breach any of the provisions of these Terms and Conditions, all licenses granted by MM Publications will terminate automatically. Additionally, we may terminate your access and use of the Website immediately at any time, for any reason, and at such time you will have no further right to use the Website. The provisions of these Terms and Conditions relating to the protection and enforcement of MM Publications’ proprietary rights, your representations and warranties, disclaimer of representations and warranties, release and indemnities, limitations of liability and types of damages, ownership of data and information, governing law and venue, and miscellaneous provisions shall survive any such termination.

10. Governing Law and Jurisdiction

10.1 These Terms and Conditions and any dispute or claim arising out of, or related to, them, their subject matter, or their formation (in each case, including non contractual disputes or claims) shall be governed by and construed in accordance with the internal laws of Greece without giving effect to any choice or conflict of laws provision or rule.

10.2 Any legal suit, action or proceeding arising out of, or related to, these Terms and Conditions or the Website shall be instituted exclusively in the courts of the Athens in Greece, Europe. You hereby irrevocably waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

11. Miscellaneous

11.1 The above Terms and Conditions and the Privacy Policy constitute the entire agreement between MM Publications and you concerning the subject matter hereof.

11.2 A waiver of any provision of these Terms and Conditions will be effective only if in writing and signed by a Director of MM Publications. Furthermore, no waiver of these Terms and Conditions by MM Publications shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure of MM Publications to assert a right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.

11.3 In the event that any of the Terms and Conditions are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect.

11.4 Any delay in exercising some or all of the rights by the parties under these Terms and Conditions does not imply the weakening or waiver of this right, which may be exercised at any time at a later stage and in the beneficiary's reasonable discretion.

11.5 These Terms and Conditions will be binding upon and will inure to the benefit of M Publications and you, and MM Publications and your respective successors and permitted assigns.
